Sweepstakes Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING A PRIZE. SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF, AND CURRENTLY RESIDING WITHIN, THE CONTINENTAL U.S. (EXCLUDING RESIDENTS OF ALASKA, DELAWARE, HAWAII, MARYLAND, NEW JERSEY AND VIRGINIA), WHO ARE ROADKING CLUB MEMBERS, OF LEGAL AGE OF MAJORITY IN THEIR STATE OF RESIDENCE AND AT LEAST 18 YEARS OF AGE AT THE TIME OF ENTRY. VOID IN ALASKA, DELAWARE, HAWAII, MARYLAND, NEW JERSEY AND VIRGINIA OUTSIDE THE CONTINENTAL U.S. AND WHERE PROHIBITED BY LAW.
Sweepstakes Period: Mobil Delvac TA Ultimate Outdoor Adventure Sweepstakes (the “Sweepstakes”) begins on August 1, 2008, at 12:01 a.m. Central Time (“CT”) and will end on October 31, 2008, at 11:59 p.m. CT (the “Sweepstakes Period”).
How to Enter:
Two Ways to Enter: 1) During the Sweepstakes Period, visit a participating Travel Centers of America, LLC, purchase an Ultimate PM or Premium PM Mobil Delvac oil change and have your RoadKing Club (“RKC”) member card swiped at the checkout counter to receive one (1) automatic entry into the Sweepstakes. Automatic entries must be received by October 31, 2008 at 11:59 p.m. CT to be eligible. Automatic entries made with lost or stolen cards (or RKC member numbers) will be void. In the event of a dispute with respect to who submitted an automatic entry, entry will be deemed made by the primary account holder of the card at issue. 2) Or, to enter by mail without making a purchase, hand-print your complete name, address (NO P.O. BOXES, except ND), city, state, zip code, daytime phone number (with area code), birth date, email address (optional), yes or no if you’d like to receive more information from Sponsor and your RKC member number (required) on a 3" X 5" card and mail entry in an envelope with proper postage to: Mobil Delvac TA Outdoor Adventure Sweepstakes, P.O. Box 282, Wilton, CT 06897-0282. Mail-in entries must be postmarked by October 31, 2008 and received by November 7, 2008 to be eligible. No mechanically reproduced, illegible, incomplete, forged or altered mail-in entries will be accepted and all such entries will be void. Limit six (6) Sweepstakes entries during the Sweepstakes Period per RKC member number, regardless of method of entry. Subsequent entries received from any RKC member number after the first six (6) entries received from that RKC member number will be void. All entries become property of Sponsor and will not be returned.
Prizes/Approximate Retail Values:
One Grand Prize: Winner’s choice of one (1) of the following trip adventures for winner and one (1) guest:
1: Grand Canyon River Rafting for 3 days/2 nights. Includes: round-trip coach class air transportation from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor) to McCarran International Airport in Las Vegas, NV, scenic short airplane flight from Las Vegas airport to the ranch, lodging for 2 nights either in an authentic Conestoga covered wagon or at the Ranch Lodge, 3 meals a day; helicopter flight to the Canyon for a 40 mile rafting adventure, a canyon hike to the waterfall, a scenic journey by jet boat through the west end of the Grand Canyon to Lake Mead and $500 spending money for the winner only (awarded as a check). Only available May through September;
OR 2: Deep Sea Fishing Trip for 4 days/3 nights. Includes: round-trip coach class air transportation from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor) to Miami International Airport in Miami, FL, three nights hotel accommodations (one (1) standard room, double occupancy), 2 full days of deep sea fishing (all tackle, bait, ice, coolers and necessary licenses are supplied), $500 spending money for the winner only (awarded as a check) and a 3 day mid-size car rental;
OR 3: ATV Adventure Tour Trip in Arizona for 4 days/3 nights. Includes: round-trip coach class air transportation from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor) to Phoenix Sky Harbor International Airport in Phoenix, AZ, 3 nights hotel accommodations (one (1) standard room, double occupancy), a 3 day mid-size car rental; a 1 day ATV guided adventure and $500 spending money for the winner only (awarded as a check);
OR 4: Fly Fishing Trip in Bozeman, MT for 4 days/3 nights: Includes: round-trip coach class air transportation from major U.S. gateway airport nearest winner’s residence (as determined by Sponsor) to Gallatin Field Airport in Bozeman, MT, 3 nights hotel accommodations (one (1) standard room, double occupancy), a 3 day mid-size car rental; a half day Ranger Hike, 1 full day of fly fishing (fishing license, park fees and rental equipment included) and $500 spending money for the winner only (awarded as a check). Approximate Retail Value (“ARV”) of each trip: $5,000. Actual value may vary based on point of departure. If winner resides within a 100-mile radius of trip destination, Sponsor reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Car rental subject to winner and/or trip participant holding a valid U.S. driver’s license and qualifying as an eligible driver under applicable car rental company policy (including the attainment of age 25) and other rental car company terms and conditions. Car rental does not include gas, tolls, parking fees, collision waiver insurance, or any other related fees and is subject to car rental company terms and conditions. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice, at least 21 days prior to travel. Winner and guest must travel together on the same itinerary and are responsible for obtaining all travel documents required by airline. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18 years of age) unless child or legal ward of winner and must execute and return a liability/publicity release prior to issuance of travel documents. If guest is child or legal ward of winner, winner must execute and return release on behalf of such child or legal ward. Certain travel restrictions and blackout dates may apply. Airfare and hotel accommodations are subject to availability. All other costs and expenses associated with the acceptance and use of the prize not stated in the prize description above as being provided (including, but not limited to, all federal, state and local taxes, fees, ground transportation, meals (if applicable), gratuities and tips) will be the sole responsibility of the winner. In the event any portion of the trip is cancelled for any reason, no compensation or substitution will be provided for that portion; however, the remainder of the prize package will be awarded and Sponsor will have no further obligation to winner. Trip must be taken by 11/30/09 or prize will be forfeited and Sponsor will have no further obligation to such winner. All prize details are at the sole discretion of Sponsor. Winner and guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such prize element(s). 5 First Prizes: A $250 Cabela’s gift card (ARV: $250). 25 Second Prizes: A co-branded jacket (ARV: $100). Total ARV of all prizes: $8,750. Gift cards are subject to certain terms and conditions as specified by issuer. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All prize details are at the sole discretion of Sponsor. All federal, state and local taxes, and all costs and expenses related to the acceptance and use of a prize not specified in these Official Rules as being awarded are the sole responsibility of the winner. No transfer, cash redemptions or substitutions are permitted, except by Sponsor who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Limit one (1) prize per household. Please allow approximately 6-8 weeks for delivery of First and Second Prizes.
- Drawing/Odds of Winning: Potential winners will be randomly selected on or about November 14, 2008 from among all eligible entries received during the Sweepstakes Period by an independent judging agency, whose decisions are final and binding. Odds of winning a prize will depend on number of eligible entries received. Potential winners will be notified via overnight mail and/or phone and may be required to execute and return an affidavit of eligibility, a liability release and, where legal, a publicity release, within fourteen (14) days of date of issuance or prize may be forfeited and, at Sponsor’s discretion, awarded to an alternate winner. If a prize or prize notification is returned as undeliverable, in the event of noncompliance with these Official Rules or if Sponsor is unable to contact a potential winner within a reasonable time period, prize may be forfeited and, at Sponsor’s discretion, awarded to an alternate winner.
- Eligibility: Sweepstakes is open to legal residents of, and currently residing within, the continental U.S. (excluding residents of Alaska, Delaware, Hawaii, Maryland New Jersey and Virginia), who are RKC members, at legal age of majority in their state of residence (and at least 18 years of age) at time of entry. Employees of Exxon Mobil Corporation (“ExxonMobil”) (“Sponsor”), Marketing Drive LLC, Travel Centers of America, LLC, participating sponsors and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotional agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Sweepstakes, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in the same household of each such employee, whether or not related, are not eligible to enter or win prize. Void in Alaska, Delaware, Hawaii, Maryland, New Jersey and Virginia outside the continental U.S. and where prohibited by law. This Sweepstakes is subject to all applicable federal, state and local laws.
- General: By participating, participants agree (a) to be bound by these Official Rules and the decisions of Sponsor and judges, which are final and binding in all matters; (b) to the use by Sponsor and its designees of their names, cities and states of residence and likenesses for advertising and promotional purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law; and (c) to release, discharge and hold harmless, ExxonMobil, Marketing Drive LLC, Travel Centers of America, LLC, and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Sweepstakes, and the respective directors, officers, agents and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, losses and damages arising out of, or relating to, their participation in this Sweepstakes, and the acceptance, use, misuse or possession of the prize (including any injury or harm resulting from use of the vehicle or any travel or activity related thereto). Released Parties are not responsible for lost, late, stolen, damaged, garbled, inaccurate, incomplete, misaddressed, illegible, mutilated Sweepstakes entries or transmission or for errors, omissions, interruptions, deletions, defects, or delayed operations or transmission of information, in each case whether arising by the way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Released Parties are not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind. Sweepstakes entry will be declared made by the authorized account holder of the RoadKing Club member submitted at the time of participation. Released Parties are not responsible for any other errors, malfunctions or problems of any kind, whether computer, network, printing, typographical, technical, human or otherwise, relating to or in connection with this Sweepstakes, including, without limitation, errors, malfunctions or problems which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of Sweepstakes entries or transactions or in any Sweepstakes-related materials. Sponsor reserves the right, at its sole discretion, to modify or terminate this Sweepstakes, should any virus, bug, technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes, and, in the event of termination, conduct drawing at random from among all eligible, non-suspect Sweepstakes entries received up to time of such action for this Sweepstakes. In the event of any such cancellation, termination or suspension, a notice will be posted here on www.mobildelvac.com. Sponsor reserves the right, at its sole discretion, to disqualify any entrant from this Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if his or her fraud or misconduct affects the integrity of the Sweepstakes. You are not a winner until your eligibility has been verified, and it is determined that you have complied with all terms of these Official Rules. All materials submitted become the property of Sponsor and will not be returned. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
